Conforme o texto aprovado, os custos poderão ser descontados do valor que o preso recebe por trabalho remunerado na prisão. Apenas os condenados comprovadamente hipossuficientes, ou seja, que não possuírem condições financeiras para se sustentar, ficarão isentos do pagamento das despesas.
Por recomendação da relatora, deputada Laura Carneiro (PSD-RJ), foi aprovada a versão da Comissão de Finanças e Tributação para o Projeto de Lei 8806/17, do Senado, e outras 21 propostas que tratam do mesmo assunto.
“O substitutivo da Comissão de Finanças e Tributação condensa em um único texto as contribuições dos diversos projetos em análise, propondo, ainda, inovações legislativas”, destacou Laura Carneiro no parecer.
Regras
O substitutivo determina que o uso da tornozeleira eletrônica será condicionado ao aporte financeiro por parte daquele a quem a pena, prisão preventiva ou prisão cautelar foi imposta. Poderá ser cobrado um valor periódico (mensal).
Os valores arrecadados serão depositados em conta determinada pelo juiz. Após a condenação definitiva, abastecerão o Fundo Penitenciário Nacional (Funpen), que financia programas de aprimoramento do sistema penitenciário nacional.
Em caso de absolvição definitiva do preso, os valores pagos serão devolvidos a ele. O substitutivo prevê ainda que o condenado ou internado terá que devolver a tornozeleira em perfeitas condições de uso e sem qualquer ônus ao Estado.
Próximos passos
Como foi alterado pela Câmara dos Deputados, o projeto deverá voltar para nova análise no Senado.
